The following terminology applies to these Terms and Conditions and Disclaimer Notice and any or all Agreements: “Client”, “You” and “Your” refers to you, the person accessing this website and accepting the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves.

All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing law of United Kingdom.

Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Disclaimer

To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our website and the use of this website (including, without limitation, any warranties implied by law in respect of satisfactory quality, fitness for purpose and/or the use of reasonable care and skill). Nothing in this disclaimer will:

1.            limit or exclude our or your liability for death or personal injury resulting from negligence;

2.            limit or exclude our or your liability for fraud or fraudulent misrepresentation;

3.            limit any of our or your liabilities in any way that is not permitted under applicable law; or

4.            exclude any of our or your liabilities that may not be excluded under applicable law.

The limitations and exclusions of liability set out in this Section and elsewhere in this disclaimer: (a)

are subject to the preceding paragraph; and (b) govern all liabilities arising under the disclaimer or

in relation to the subject matter of this disclaimer, including liabilities arising in contract, in tort

(including negligence) and for breach of statutory duty.

To the extent that the website and the information and services on the website are provided free of charge,

we will not be liable for any loss or damage of any nature.

Ordering Time & Cancellations

Ordering time for cakes/ cupcakes 1 week prior to collection/ delivery date. Cup cakes can be pre-orders 2 days before collection/ delivery date if availability. Call us to check availability

•             Cancellation period is 72 hours prior to collection / delivery date to receive full refunds.

•             Deposit of 25% of final value of price is required on placing the order via bank transfer/ Paypal or cash payment

•             Any cancelations over 72 hours from collection time can be processed and customer is offered a credit note equal to the price of the cancelled product. Collection date changes can also be made.

•             Free delivery in Edinburgh and final payment of 75% required on delivery by bank transfer/ Paypal or cash payment.

Complaints

At Edinburgh Cakes we always try keep the highest standards and consistency to our highest quality. However, if a customer feels their product is not of standard they must bring the product to us within 24 hours of collection. After testing by management, a credit note will be issued if the product is faulty. Judgement on weather or not something is faulty will be based solely on the decision of the manager. Credit note is not guaranteed if the manager feels the product is of standard. During this time products containing fresh cream must be kept refrigerated.

Collection

•             Orders may not be ready before selected time slot.

•             Customers are responsible for collecting their cake on time and within opening hours.

•             Missed collections can be kept up to 72 hours after the original collection time only if the customer has contacted and notified management of a new collection time.

•             Upon collection, customer is responsible to check if all details of their order are correct.

•             Final product designs may differ slightly from designs displayed on our website or brochures.

•             Customer is responsible for checking if all spelling, design, decorations and colour are correct. Any complaint concerning these matters after collection will be invalid.

•             Customer is responsible for ensuring cakes are transported away from our sites safely on a flat surface. Customer will be responsible for any damaged cakes.

•             Cakes containing fresh cream must be kept refrigerated after collection and transported in a cool environment.

Colours

•             Shades of colours may slightly differ from images presented.

•             Coloured cream may stain.

•             Coloured Cream may cause hypertension in children.
